The European Union Added 22 Hazardous Substances to PIC for Export Notification

On 20 April 2022, the EU released the revised Prior Informed Consent (PIC Regulation) on the import and export of hazardous chemicals, which will start to apply from 1 July 2022. EU exporters will be required to notify their intentions to export 22 chemicals following an amendment to the PIC Regulation. The amendment also bans the export of four chemicals.

The 22 additional chemicals include 15 pesticides and 7 industrial chemicals, including all substances containing benzene as a constituent in concentrations above 0.1 % weight by weight. Besides, most of these chemicals need to receive explicit consent from the importing country before exporting.

Background

The Prior Informed Consent or PIC Regulation (EU) 649/2012 regulates the import and export of certain hazardous chemicals and imposes obligations on companies intended to export these chemicals to non-EU countries. The PIC Regulation entered into force on 1 March 2014.

Banned or severely restricted chemicals listed in Annex I to the PIC Regulation :

• Active substances in pesticides (e.g. atrazine or permethrin) or in biocidal products such as disinfectants, insecticides or parasiticides (e.g. malathion or didecyldimethylammonium chloride)
• Industrial chemicals (e.g. benzene or chloroform)

Chemicals that are banned for export from the EU listed in Annex V to the PIC Regulation (e.g. persistent organic pollutants or some mercury compounds).
